Burglary suspect shot by victim after breaking into Dallas apartment, police say

DALLAS — A resident shot a burglary suspect who police say was trying to break into an apartment in Dallas early Sunday morning, officials said.

Officials tell WFAA that they responded to a shooting call at about 5 a.m. in the 9800 block of Walnut Street, according to a police news release.

Based on their initial investigation, police believe the suspect, identified as 46-year-old Nickolaus Benitez, tried to break into the victim's apartment when he was shot by the victim.

Police said Benitez was sent to a hospital and has been treated for his injuries. He has since been arrested and charged for Burglary of a Habitation with Assault.

The incident is still under investigation, according to police.
