DALLAS A Dallas County jury on Saturday handed down the death penalty to Franklin Davis, who was convicted of killing his children's babysitter.

In their second day of deliberations, the jury selected execution over the alternative of life in prison without parole. The panel was unable to reach a verdict after considering the facts for six hours on Friday.

Davis, wearing a dark suit, a blue shirt and a tire, smiled when his sentence was read.

The same jury on Tuesday convicted Davis of capital murder in the 2012 slaying of 16-year-old Shania Gray of Carrollton. The girl alleged Davis raped her and planned to testify against him.

'It's been very hard for the family; it's been very scary for [Shania's] family. There's been threats on the family also with this guy,' said Davis family friend Cleo Marshall. 'This was the best decision to make.'

Davis admitted to killing Gray, but denied sexually assaulting her when she was 14.

'The jury's verdict fortifies her reputation,' said chief felony prosecutor Brandon Birmingham. 'He tried in court so hard to trash it, to make her look bad, but the jury saw right through that, and that's the thing that I'm probably most proud of.'

Shania's mother was not in court for the sentencing. She told friends over the phone she's better than okay, and glad Davis will pay for his crime.
