A city official said the second raid was necessary after authorities found an unspecified amount of alcohol on Saturday.

DUNCANVILLE – The Texas Alcoholic Beverage Commission and city police raided a swingers’ club Tuesday — three days after a weekend raid.

Cherry Pit owners, Jim Trulock and Julie M. Norris, returned to their home at about 3:45 p.m. to find their driveway blocked off by a city police cruiser and the driveway full of TABC vehicles.

“We have no affidavit from the search on Saturday night and now the TABC is busting down doors, having their fun with the place,” said Cherry Pit attorney Ed Klein.

City officials said they did have a search warrant.

Tonya Lewis, the city’s public information officer, said the second raid was necessary after authorities found an unspecified amount of alcohol on Saturday. Police confiscated personal items from nearly 60 individuals at the home Saturday night, but couldn’t take any of the alcohol because it wasn’t listed in the initial search warrant.

“It was a very large amount,” she said. “I can stress very and you can use your imagination from there.”

Authorities went back to the judge for permission to execute Tuesday’s search warrant.

The city has worked since last fall to shut down the doors to the Cherry Pit. In November, Duncanville leaders adopted an ordinance that bans sex businesses. Klein sued the city in December. Then in January, the City of Duncanville filed a countersuit, asking a judge to shut the club’s doors.

Trulock. 59, and Norris, 30, have since received 10 citations, five for operating a sex club and five for operating a sexually oriented business without a license. Mr. Klein is challenging those citations in municipal court. That case was scheduled to be heard today but was postponed.

City manager Kent Cagle said in addition to violating the sex club ordinances, authorities are looking into prostitution and money laundering.

Klein expressed disbelief that the city would work so hard to shut the operation down.

“I’m sure that the city has decided they will use any resources they have available to them to shut this place down, to run them out of town.”
