City fights to shut down swinger parties

DUNCANVILLE - A swingers club operated out of a Duncanville home has stirred up controversy.
The city of Duncanville has placed no parking signs in front of the home, located along Cedar Ridge Road and Interstate 20, in an attempt to control some of the traffic that collects during weekend parties at the home. However, despite resident complaints, the law has not allowed the city to control what goes on inside the private residence.
Some believe the swingers club is such a problem that the city will discuss a change of law at a meeting Tuesday.
An internet site advertising the club calls the location the "Cherry Pit," which is a private swingers club where visitors share hot tubs and rooms full of beds.
"They shouldn't have establishments in a community full of children," said Kelli Habkney, a nearby resident.
Authorities say the place is hard to close since the Cherry Pit only asks for donations, which makes it not an illegal business.
Some neighbors said they haven't had a problem with the club.
"Well, that's up to the city," said resident John McCormack on shutting down the operation. "I mean, if it's a problem for other people, maybe so, but it is certainly no problem for me. So, to each his own."
However, enough people have complained that the city is proposing a Duncanville sex club ordinance, which says "the operation of a sex club as unlawful and a public nuisance, which shall be abated." Abated is government lingo for shut down.
The homeowners said they will "absolutely" fight the ordinance.
"We looked at other cities' laws, including Phoenix, and styled this on one approved by the 9th Circuit of Appeals," read a statement by Bob Hager, a Duncanville lawyer.
Tuesday's meeting with council members and city lawyers will take place behind closed doors, which is allowed when a city believes their action may lead to a lawsuit.
