Frisco residents sue to stop alcohol sales in election protest

Two Frisco residents have sued Denton County over an alcohol election held there in May.

Voters in Frisco's Precinct 2 on May 9 approved the sale of alcoholic beverages, including mixed drinks. Al Gibson and Richard Belyan filed suit June 23, asking a state district judge to throw out the election results and issue injunctions preventing anyone from obtaining a license or permit to sell alcohol in the area.

The plaintiffs' attorney, Richard Abernathy, could not be reached for comment.

County Judge Mary Horn said she could not discuss the case.

"We just have to let the process move through," she said.

In their suit, Gibson and Belyan claim that part of the territory now in Precinct 2 used to be in Precincts 3 and 6. Elections in those precincts have previously prohibited the sale of alcohol. The plaintiffs say that because May's election did not include all the original territory under prohibition, as required by law, the result is void.
