DALLAS — An administrative judge will hear arguments on whether a judge who cited the Dallas County district attorney for contempt of court should be removed from the case.
The Friday hearing comes after attorneys for District Attorney Craig Watkins asked state District Judge Lena Levario to recuse herself from the matter. They allege Levario is biased against Watkins.
On Monday, Watkins' attorneys persuaded Judge Bob Brotherton of Wichita Falls that Levario failed to include a punishment for Watkins in her order or a way for him to have the contempt citation lifted. Before Levario could amend her order, Watkins' attorneys asked her to recuse herself.
Watkins has refused to answer questions about his office's prosecution of an oil heir for mortgage fraud. He could be jailed if convicted.
