Accused dentist seeks restraining order against WFAA

DALLAS – Dallas dentist Dr. Richard Malouf and his wife Leanne are asking a district judge in Dallas for a temporary restraining order against WFAA-TV, reporter Byron Harris, real estate blogger Candy Evans and the Maloufs' next door neighbor, Laura Wilson.

Malouf is the founder, and still part owner, of All Smiles Dental Centers (ASDC). ASDC is one of 26 orthodontic firms whose Medicaid payments have been withheld by Texas for credible allegations of fraud.  Additionally, Malouf is accused of billing fraud in a whistleblower lawsuit filed by the Texas Attorney General.

The temporary restraining order alleges, among other things, that if WFAA-TV takes pictures of Malouf's back yard, where he is building a three-story water slide, he and his family will suffer "imminent irreparable harm."  The TRO also alleges that Harris has defamed Malouf.

In sworn affidavits, Malouf and his wife allege that WFAA and Harris "stormed" in on a "private civil hearing" in a Dallas courtroom last week. Watch Harris "storm" the courtroom in this raw video filmed by a News 8 photojournalist.

A judge is scheduled to hear the arguments for the temporary restraining order on October 19. The full documents are posted below.
