Fort Worth mom accused of kidnapping daughter appears in court

FORT WORTH - The Fort Worth mother accused of kidnapping her own daughter last February appeared in court today.

Kimberly Smith, 42, was in the Tarrant County Jail since February, when she was arrested for kidnapping her 11-year-old daughter and driving her to New Mexico. She paid a portion of her $75,000 bond and was released Monday.

Smith was required to be in court as her lawyer filed motions in her upcoming trial. She looked very different from the night police found her and her daughter in New Mexico hungry and exhausted.

The mother was charged with aggravated kidnapping. According to court documents, a witness claimed Smith tried to suffocate her daughter by stuffing a rag into her throat the night before the two vanished.

Affidavits also revealed the girl told a counselor that her mother was trying to make her lie and say her father had molested her.

Smith and her husband were in the midst of a contentious divorce.

Smith refused to talk with News 8 as she left the courtroom.
