PROSPER — A 17-year-old former Prosper High School student is behind bars in the Collin County Jail charged with sexual assault for a second time.
Garrick White and Alex Shelwood are both accused of raping a 16-year-old girl in McKinney in May. Along with four other teens, White was arrested last year on similar charges.
According to a search warrant obtained at the Collin County Courthouse, the victim said two males took her to a McKinney park and forced her to have sex.
In the warrant, the victim was allegedly ordered to perform oral sex.
"This is the prime example of the harm that is done by false accusations," said Coleman Sylvan, an attorney who represents White.
Sylvan argued the sex was consensual, and said the alleged victim had contacted White over Facebook asking him for a ride to North Carolina.
But that ride never happened, and White and Shelwood took the girl to the park in McKinney. The sex happened in the car with both men, and was allegedly videotaped.
Garrick White was one of five young men in Prosper arrested for a sexual assault last year. News 8 learned that child was a 16-year-old girl reportedly attacked off-campus. White was the only one indicted, but on a lesser charge of unlawful restraint of a child.
The indictment came down in February, but Sylvan said there was a connection to the new incident.
"The new accusation stems from someone who was friends with that other individual that accused him who knew how to get him in trouble," he said.
White and Shelwood face charges of sexual assault of a child, which is a second-degree felony that carries a two to 20-year prison sentence and registration as a sex offender.
The Collin County District Attorney’s Office did not comment on the case since it's still pending.
McKinney police filed the case with the office, which has 90 days to get an indictment after the arrest to keep White in custody.
