DALLAS -- According to new Dallas police documents released on Monday, 3-year-old Josiah Garcia allegedly died because he was not potty trained.
The suspect, Christopher Garcia who is the child’s mother’s boyfriend told police that he
"struck the complainant many times to his chest, back, and stomach with his open hand, a closed fist and a belt."
He went on to say the fatal blow came when he “hit the complainant in his stomach because the complainant said that he had to use the bathroom."
According to the documents, Josiah died a slow and painful death.
His brother told investigators that Josiah’s ”face was gray with bruises everywhere.” The report states he asked Garcia on the morning of his brother’s death if Josiah was dying.
Josiah's aunt told News 8 that what was done to the child was vicious.
“I have no thoughts of him,” Felicia Garcia said. “He's a monster. The only thought I have of him is sinful and I don't want to think like that. He's a monster and what they give him, he deserves."
Dallas police sources said at the time of Josiah's death he looked like he had been in a boxing match.
Christopher Garcia has been charged with capital murder.
