No one wearing seat belts in fatal Labor Day wreck

DALLAS - Two family members remain in critical condition and 10 others hospitalized after a crash that killed an infant as the Dallas family headed to Mexico for a family reunion on Labor Day.

Authorities said none of the 17 people in the van were wearing seat belts when the driver lost control after a tire blowout on Interstate 35E in Hill County. While there was a car seat on board, the six-month old baby girl who died was not inside it, investigators said.

A 19-year-old woman and a 32-year-old man remain hospitalized in critical condition at Baylor University Medical Center in Dallas, and a 19-year-old woman is in the same condition at John Peter Smith Hospital in Fort Worth.

A nine-month-old girl; a 23-month-old girl; a three-year-old boy; a three-year-old girl; and a seven-year-old child were taken to Children's Medical Center Dallas for treatment; all had been released as of Tuesday, according to a spokeswoman for the hospital.

While it was thought the driver of the van was a female, it was actually 66-year-old Albert Luna, who investigators said will soon be interviewed. He is listed in good condition and denied requests for an interview from WFAA.

As of yet, investigators said Luna faces no charges in relation to the crash.

Of the 17 on board, the only one to walk away unharmed was the mother of the six-month-old girl killed in the crash.
