MONTAGUE — A Montague County grand jury decided to delay a decision on charges in the accidental shooting death of a popular Denton Guyer High School student.
Nate Maki, 18, was killed over the Labor Day weekend while on a hunting trip.
Montague County investigators say Michael Bryce Underwood, 17, shot his friend accidentally.
Although the Montague District Attorney presented its case to the grand jury Thursday afternoon, the jury decided to delay an indictment decision until October because three of its 12 members were absent.
Underwood was arrested on an underage drinking charge in relation to the August 31 incident.
Maki was a popular student and standout football player at Guyer.
Last week, hundreds turned out for an emotional memorial service and he was remembered at the school's football game.
He and Underwood, along with some teenage girls, were on an overnight hunting trip when a rifle Underwood was handling went off.
Maki was shot once and killed.
An attorney for Underwood told News 8 earlier in the week they wouldn't comment until after a grand jury decision.
